terms and conditions

The placing of an order, verbal or written, with Split Image Ltd shall be deemed as acceptance of the Company’s terms of business by the customer.

  1. Normal Working Hours​:
    09.00 - 17.30 hrs. Monday to Friday.

    Overnight or Weekend work by arrangement and quotation service times subject to workload.
     

  2. Credit and Payment Terms

    Settlement of accounts is strictly 30 days nett unless stated otherwise on the invoice or previously agreed in writing. Split Image may charge interest on overdue accounts until the date of payment at the monthly rate of 3% above HSBC lending base rate of the overdue balance together with its current standard administration charge for overdue accounts, such amounts being payable without prejudice to Split Image’s other rights and before as well as after judgement.


    All the prices listed or quoted are exclusive of VAT. VAT will be levied at the current rate on all orders unless specified otherwise in WRITING at the time an order is placed.
    Split Image reserves the right to vary the prices set out in its price list from time to time. Current prices will be available upon request.

     

  3. Delivery

    Items supplied by Split Image are dispatched by first class mail unless a customer stipulates a special method of delivery in which event items are delivered at the risk of the customer and an extra charge may be made for delivery. Any stated delivery date constitutes reasonable endeavours to effect delivery, by or about that date.

    No liability will be accepted by Split Image for failure to meet delivery dates, however caused. Should delay be experienced in the completion of an order the buyer does not have the right to cancel his order either entirely or in part.

    In any event any liability for loss or damage in the course of delivery shall in all circumstances whatsoever be limited as set forth in the Limitation of Liability clause.

    It is the responsibility of the customer in all cases to establish loss or damage.

     

  4. Complaints

    In the case of either any complaint concerning the delivery or quality of the items or query concerning an invoice, customers should telephone Split Image with either the Invoice or Job Number for reference. All complaints with regard to either invoice or products must be communicated within 7 days of either the delivery date or the invoice date.
     

  5. Title and Risk

    Until full payment is received by Split Image Ltd for all items/services provided, all items remain the property of Split Image. The rights under sections 77 and 80 of the Copyright Designs and Patents Act 1988 are hereby asserted by Split Image. Unless notified otherwise, Split Image Ltd, may from time to time, reproduce or display any material created for its own promotional use.


    The customer shall store the items in such a way that they can be readily identified as being the property of Split Image and at all times in accordance with Split Image’s recommendations.

    It is understood that any client / customer placing an order for copying, printing, adding music, video duplication, editing etc, with Split Image, has the necessary copyright clearance to do so and will indemnify Split Image Ltd against any claim or breach of the Copyright Designs and Patents Act 1988.
     

  6. Quality/Measurements

    Where technically possible and within the tolerance of materials used, customers colour balance requirements will be taken into account. In the absence of specific instructions or match samples, colour balance will be at the discretion of Split Image. In the absence of specific instructions video file formats, editing and duplication will be at the discretion of Split Image.
     

  7. Limitation of Liability

    Split Image undertakes to take every reasonable care in handling customer’s products, materials, originals, samples etc, but cannot accept unlimited liability for loss or damage howsoever caused. The charges made for the services provided do not reflect or incorporate any unlimited liability.

    Split Image’s liability for loss, damage, or production errors are limited to £50.00 or replacement of the materials used and no other liability will be accepted. Any claims must be notified in writing within 5 days of delivery.

    Split Image strongly advises that where products, materials, originals, samples etc, are known to have a high value, the customer should insure them to their full value against all risks.
     

  8. Verbal Orders

    Split Image accepts verbal orders and instructions for the convenience of its customers, but no liability can be accepted for misinterpretation of such instructions. Changes in instructions can only be undertaken without charge if received before work is commenced.

    Split Image recommends that all orders and instructions are supplied clearly in writing to avoid misinterpretation​.

     

  9. Amendments
    Split Image reserves the right to alter or amend these Terms & Conditions generally or for any particular class of products or customer.
     

  10. Customer Order Conditions
    Any provisions of the customer’s order which conflict with, or in addition to Terms and Conditions of Split Image shall be excluded.
     

  11. Backup & Storage

    Split Image assumes the client will take full responsibility to back up all image files supplied to them. By default, Split Image will hold client files for a period of 3 months after the date of supply (unless explicitly informed in writing not to). Split Image cannot be held responsible for any data loss howsoever caused.
     

  12. Non - Applicable Consequences

    Should any of the present Terms & Conditions be inapplicable this would not imply that the rest of the present terms do not remain valid.

  13. Confidentiality

       Split Image Ltd has a commitment to client confidentiality. Any information obtained in the course of carrying out our               services will be held in confidence. We have Non Disclosure Agreements with many of our clients and suppliers.
